An investment-grade obligor for this program is typically rated by SP and Moodys with an acceptable rating. There are exceptions and substitutes, however, for these rating criteria. If a company is not rated, there are alternate procedures to qualify said obligor. An obligor is typically a customer or other third party who has contractually agreed to make payments to the client or guarantee payments for the client within a term of 1-30 years. In one sense, monetization financing can be viewed as a longer-term variation of factoring without the high cost and other major differences associated with factoring.

As your new president, I face a challenging task when it comes to speaking to you about school finance. Let me give you my dilemma. It is the end of the school year as I write this piece and I am reflecting on the uncertain state of school finances in coming months and what these financial challenges mean for us as school system leaders. You will share my frustration that as many as half the nations students may be directly shortchanged of the education they deserve, with the remainder not immune to the impact of belt tightening. As bad as that news is, last year at this time NCSL found 36 states with budget gaps. On the other hand, NCLB and IDEA could be funded retroactively, which would help make up for last years budget shortfalls that resulted from unfunded or underfunded mandates. If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. If youre not in that sunny camp, please continue and let me share my thoughts.

In actuality, the seminar focused little on the overall problem of health care fraud in liability claims, but focused clearly on the activities of chiropractors, with a primary emphasis on multidisciplinary practices and mobile electrodiagnostic testing labs. After the seminar, one could have left with the belief that health care fraud and chiropractic were synonymous, as the speakers continually attacked chiropractors, with no care taken to remind their audience that not all chiropractors engage in fraudulent activity! It was quite apparent that the speakers had an US (insurers) against THEM (chiropractors) attitude. Clearly, the chiropractic profession was not presented as a viable part of the solution in combating fraud and a member of the health care fraud fighting team, but as the target of it!In one presentation, after the speaker failed to mention the chiropractic examining boards role as a source for investigators to report suspected chiropractic fraud, I informed him of this oversight and requested he inform his audience. My request went unanswered.In another presentation, a speaker from Washington State did mention the chiropractic board as a potential source for combating fraud involving chiropractors, but added that it did not do any good until now, “because we have beat them up.” It was ironic to listen to the silence and comments of these speakers in a hotel located just across the street from where the Federation of Chiropractic Licensing Boards (FCLB) had held its annual conference just months earlier. The FCLB meeting included discussions on health care fraud/abuse trends and efforts to combat the fraud!

The star of the Amnesty International film, which is being released online next month to highlight the agony of such interrogation techniques, said he found the experience painful, both physically and psychologically. In secret jails across the world, Amnesty insists, captives in the fight against terrorism are expected to maintain these poses. They are not considered torture, simply “enhanced interrogation techniques”. Alfred McCoy, a professor at the University of Wisconsin-Madison, argued recently that the photographs from Abu Ghraib reflected standard CIA torture techniques of “stress positions, sensory deprivation, and sexual humiliation”. In August, President Bush issued an order decreeing that Article 3 of the Third Geneva Convention - which prohibits the humiliating or degrading treatment of prisoners of war - should apply to the CIAs detention and interrogation programme. But Amnesty believes the order does not go far enough in specifying what constitutes degrading treatment.

In this area, there are nine regional rainwater utilization systems with underground tanks of three to five metric tons. Many people carry cell phones as a safety measure, but in certain cases their value is limited. In an emergency situation, a cell phone can be used to call 911, but unless the person calling can give instructions on where the emergency is, dispatchers are helpless to know where to send help.
At any given lime during the day, an estimated 500,000 passenger vehicle drivers are talking on hand-held cell phones, according to the National Highway Traffic Safety Administration. As cell phone usage continues to climb, more and more studies have looked into the impact that talking on the phone while driving has on safety. In response to such findings, New York, New Jersey and the District of Columbia have banned the use of cell phones while driving and other slates are currently considering lull or partial bans ol their own. However, the debate continues because many ol these states still allow the use of hands-free phones while driving and opponents of hands-free use counter that the main cause of accidents is the distraction caused by a phone conversation, not the operation of a hand-held phone. Regardless of cell-phone ban details, many corporations are recognizing that a real risk exists concerning cell phone use and, in an effort to avoid costly litigation stemming from an accident caused by one of their own distracted drivers, are re-evaluating their own phone-use policies. As part of its own recommendation for companies to consider a ban on cell phone use while driving, the California Association of Employers has even put a sample cell phone policy on their website.
A new study funded by Motorola Corp. suggests that cell phones do not pose a cancer disk, reports Promotive Communications Inc. However, experts say its too soon to rule out a negative health impact of cell phones. A 13-nation study on the relationship between cell phones and brain tumors is under way. The results are expected to be released in 2004.

Heart of the kitchen is a six-sided 9 1/2-foot-long island that provides storage for dishes, knives, and spices, as well as a cooktop and a snack counter serving four. For convenience, dishes are stored in the side of the island facing the sink and dishwasher. A U-shaped drawer for pots and pans pulls out under the cooktop.
Call it catalytic conversion: remodeling cleaned up this small kitchen and helped it function more efficiently. Before, though the sink and most appliances seemed to be in the right places, there wasnt quite enough counter space. And heavy-looking painted wood cabinets and a crowded breakfast area made the entire kitchen seem cramped. For more comfortable seating, a built-in bench now wraps a corner of the eating area. The windows were restyled, with a new one added to the kitchens long wall; the breakfast areas section of this wall was pushed out about 1 1/2 feet.
Angled work stations organize this remodeled kitchen, helping to disguise its disproportionate narrowness. The trapezoid-shaped sections–one each for sink, cooktop, refrigerator, oven, desk, and pantry–provide individually tailored spaces for each basic task or appliance. The largest counter, for the sink, is 10 feet long and puts into the room at a 9-1/2[deg.] angle. Its widest near the breakfast area, where it provides a place to set dishes. It narrows at the opposite end to make room for floor-to-ceiling cabinets.

With gusts of over 30 knots blasting over the Holy Loch, several dinghy sailors found it nigh on impossible to get their boats righted in the difficult conditions. In the slow dinghy class, Strathclyde Loch Sailing Clubs Crawford Reid produced two firsts in his Albacore, putting him out in front as a clear leader in the 13-strong class and Alan Milton in Pepsi took two more decisive wins in the Sigma 33 class. Cove Sailing Clubs Alan Harper in Pied Piper sealed a championship win with a second and fourth, while Clyde Cruising Clubs Donald Sharp had two good wins and lifted the IRC Class 2 crown.
Steve Pettengill, of the United States, sailed into Charleston, South Carolina yesterday to take second place in the 27,000-mile BOC Challenge. Pettengill, sailing Hunters Child, completed the voyage in 128 days, four hours, three minutes and nine seconds. The Frenchman, Christophe Auguin, won in 121 days, 17 hours, 11 minutes and 46 seconds.

The book covers four areas relating to life with reduced stress: wholesome diet, herbal medicines, vital energy, and visualization and meditation. For the lay reader the book is a very good textbook review of all aspects of stress. But when the name of the worlds most foremost stress researcher, Hans Selye, is misspelled, one wonders what other errors there may be. The author never shows an antagonistic stance toward modem medical treatment, as so many books on “natural healing” do. He simply contrasts for each of the many stress conditions what a doctor will do and what a natural healer will do. There are many good tables listing prescription and over-the-counter drugs against stress symptoms, and a 43-page chapter, “The Herbal,” describing in detail 19 plant sources that have been recommended in stress treatment. For most herbs there is no experimental record of safety and efficacy, just the lore of the centuries with only occasional support from the literature of science. It also seems that much of the herbal information in this book has been filtered somewhat. Shouldnt a discussion of catnip also state that the Food and Drug Administration classifies catnip as an herbal of “undefined safety.” All the herbs listed are home to hundreds of potent chemicals, and even a nonchemophobe ought to question whether physiological potency occasionally crosses the direshold of toxicological potency, as the author points out for caffeine, alcohol, tobacco, and ephedrine.

Hydroponics comes from the Latin words hydro, which means water, and ponos, which means to work. The idea behind hydroponics is that if you can provide a inert soil-less substrate, such as rockwool or perlite, and feed it with a high quality hydroponic nutrient and water solution, either timed or constantly, your plants will grow faster and produce more fruit. How? Your plants roots are not required to expend lots of energy on a massive root system to find food, and the air to water ratios in the soil-less media are much higher, which plants like. There are severed different ways to garden hydroponically, but the common denominators between the methods are the water, the hydroponic nutrient, and the soil-less substrate. Generally, you will choose a method that matches the type of crop you are growing. For instance NFT, or nutrient film technique, would be used for smaller crops, and a top drip system would be used on larger crops. If all of this sounds Greek to you perhaps you should try the simplest and perhaps most high performance method, water culture. Water culture is as simple as putting an aquarium bubble stone attached to an air pump in a tray of nutrient rich water. Just add your plants in the tray and watch them explode. The novice hydroponic gardener must also be made aware of the pH of the water and the amount of nutrients present in the water. To test pH, you can get a digital meter for about $50, or you can get litmus paper or a dropper kit like the ones used for pools. Generally, plants like the pH to be between 6 and 7, however some plants like it lower or higher, so find out what your plants need. Measuring the amount of nutrients in the water takes a meter that you can get for about $100 (cheaper meters are much lower quality). This meter will measure the TDS, or total dissolved solution in the water. These meters cannot tell which elements are actually present, rather they measure all of them combined. The amount of total dissolved solution needed will vary depending on crop. Lettuce, for instance, likes a 400-600 ppm range while tomatoes will need 2200-2600 ppm.

From action-oriented content to more efficient workflows, six pros tell how the Internet is moving design forward–both online and off Getting stock photography or illustration for last-minute editorial changes used to be a mad scramble, and logistics often ruled out getting exactly what I wanted. But with all the major stock houses online now–some with very sophisticated search engines and well-designed user interfaces–finding the stock art I need is actually enjoyable. Factor in being able to download files for immediate use or, at the least, pulling in the screen shot for FPO (eliminating the need to scan all those tiny stock book pictures), and the process couldnt be better. My favorite sites are Corbis and Newsmakers. From a production standpoint, the Internet has given me a tool for doing much better work under the same crazy deadlines. From a design standpoint, its had little effect on me. Idealistically, theres little reason it should. The Net is a very different visual medium than print, because it can incorporate sound, animation and video. But has there been an effect on design? In several ways, the answer is yes–and all are negative. Because of the explosion of Web content, design talent has been spread thin. Often, too, designers are burdened with living in both worlds–print and Web design–which presents very difficult technical problems. Just as the integration of the computer into magazine design workfiow suddenly made designers accountable as production managers and technicians, so has the Internet forced many designers to try to become bilingual. Its hard enough maintaining fluency in Quark, Illustrator and Photoshop. Adding Dreamweaver, Fireworks and Flash sustains the designers evolution from aesthete to technician.
Put usability first; practice simplicity Scores of books purport to offer insight into successful Web site design. At least one actually does. Jakob Nielsens Designing Web Usability (published by New Rider, Indianapolis) is accessible (with plenty of color plates illustrating his ideas) but dense with practical and sometimes idiosyncratic advice. It is recommended reading for agency principals and Web managers alike. Some people label Nielsen opinionated, but thats his value. His insights are based on experience and experiments, not simply taste and intuition. You can be as clever as you want with your Web site but once you read Nielsen, you may feel like an idiot. So read him first.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

Protocols could be its Achilles Heel Softswitching technology follows a basic underlying premise: that by using IP-based protocols and standard Java or C++ development environments, the PSTN will be easier to upgrade with new data services as they are introduced. The companies behind the softswitch movement are seeking to separate telephone switching into non-proprietary structural elements: standard software on one side, and interoperable–that is, non vendor-specific–hardware on the other. This concept is the bedrock on which computer networking technology is based. In the Public Switched Telephone Network, interoperability is uncommon. For example: The majority of telephone calls are handled by Class 4 and 5 circuit switches, which handle call routing, status, and distribution. Class 4 and 5 switches traditionally use proprietary hardware and software, and even proprietary development environments. For new services (and hence new routing functions) to be added, significant upgrades are necessary, and the rule of thumb is an 18 month turnaround time for new services to be rolled out.
The software reduces fraudulent cellular calls by blocking them before they are connected. At this time, the system only alleviates tumbling fraud. I am talking about the chronic givers–elderly people and those who are doctor dependent. One woman has kept me in eight varieties of home made jam for years. To her I give excess produce from my garden (whether it is suitable for incorporation in jam or not). Patients who insist on bringing chocolate for my children on ever), visit receive some sort of confectionery from them at Christmas. You may argue that by this reciprocity I am perpetuating the situation. I feel it restores a balance. Some patients do not like it, which is fine by me. If they refuse to accept a gift from me how could I possibly take one from them? At this point I have to admit that I was brought up giving presents to patients. I clearly remember, as a child in the 60s, doing the Christmas round with my father, who was also a general practitioner. The back of his car contained a large cardboard box of poinsettias and half a dozen individually wrapped baby bottles of champagne. As darkness fell and Christmas lights came on in windows we would drive from one fusty home to another, greeting impossibly old and decaying and undoubtedly lonely people. Everywhere the welcome was warm; sometimes there were drinks and mince pies, and we collected chocolates and bottles ourselves as the afternoon progressed. These patients had become special to my father over the years by virtue of their age, their disabilities, their social isolation, or just their personalities. Moreover, I suspect that giving as well as receiving at Christmas helped him to maintain a position of strength through the ensuing 12 months of regular visiting, a feature of general practice in those days.

Volunteers are using 10,000 cheese rounds to build a 12-foot replica of the church. “As far as we know no church has ever been built from cheese before,” project spokesperson Nel Eijek told Ecumenical News International. Race is one of the most sensitive aspects of the public debate on crime, striking at the heart of whether our justice system is fair. Clearly, from a statistical point of view, an American citizens relationship to the criminal justice system is heavily influenced by his or her race. According to the Sentencing Project, a group that advocates alternatives to incarceration, one in three black men ages 20 to 29 was under the supervision of the criminal justice system in 1995 (for white men, the ratio was one in fifteen that year; for Hispanics, one in eight). Bureau of Justice Statistics show that blacks rate of imprisonment outnumbers that of whites seven to one. Whether these differences result from a disproportionate percentage of crime by black people, discriminatory sentencing, disparities in quality of counsel, something as fundamental as economic disadvantage among blacks, or some combination of these factors, is open to debate. The announcement was made in Chicago, where Gay Games VII will take place July 15-22. A rival event, Outgames 2006, is scheduled to begin July 29 in Montreal, the original 2006 Gay Games host city. As Outgames boasted nearing 10,000 registered athletes at press time, Chicago organizers continued to predict more than 12,000 participants. So maybe two Games are better than one.

Many of the trucks you see on the roads today are insured on one of three commercial auto insurance contracts: the truckers form, the motor carrier form or the business auto form. The truckers form is used for firms hauling only goods owned by others. The motor carrier form insures firms hauling both their own goods and the goods of others. The business auto form is used to cover firms hauling only goods that they own. The Insurance Services Office, Inc. (ISO), promulgates all three contracts. We will discuss the exclusions under the business auto policy and how to provide coverage for the excluded risks. To do so, we will consider several examples. In a fictitious example, MBF Corp.s (MBF) annual planning conference was going to be held at a mountain lodge. Conference attendees from all over the country would need to fly into a nearby town, rent four-wheel drive vehicles and drive about 20 miles to the lodge. The last five miles of the route required four-wheel drive vehicles because there was no pavement, only a trail created by vehicles driving over the mountain terrain. In spots, this trail was steep and in other places it was steeply slanted to one side or the other.
RISK PROBLEMS/SOLUTIONS Our fictitious business, Riverside Hardware Store, Inc. (RHS), owned several vehicles, including all of the business owners personal vehicles. Besides the personal cars, RHS also owned several pickup trucks. The owners insurance company wrote the coverage using the most restrictive covered auto description that was available. The restrictive coverage is shown on the Business Auto Policys declaration page as “specified autos only.” There was no premium difference between using the broadest description of covered autos and the most restrictive definitions of covered autos. Prehistoric North Americans apparently fashioned shoes in regional styles using a variety of materials and techniques, contend archaeologist Michael J. OBrien of the University of Missouri at Columbia and his coworkers. The design and weaving observed in the oldest specimen are about as complex as what we see in later ones that weve dated to around 1,000 years ago, OBrien says. These people knew exactly what they were doing.

Figures to be published tomorrow by the British Association of Aesthetic Plastic Surgeons (BAAPS) show that 2279 patients had face or neck lifts in 2005, up 42.1-per cent on 2004. There was a 50.2-per cent increase in the number having eyelid surgery - some 3415 patients - and a 34.8-per cent increase in the number of people having brow lifts, a total of 580 patients. Eyelid surgery is the second most popular procedure after breast augmentation.

Dr. Jochen is an expert on this procedure and has performed hundreds of blepharoplasties. According to Dr. Jochen, “The best candidates for this surgery are men and women who are in good physical health and have realistic expectations. Most of the blepharoplasty patients I see are age 35 or older, but if droopy or baggy eyelids run in the family, the patient may opt for surgery at a younger age.” Blepharoplasty generally is performed on an outpatient basis, under local anesthesia-which numbs the area round the eyes-along with oral or intravenous sedation. The procedure takes one to three hours. Dr. Jochen will make incisions that follow the eyelids natural lines, in the creases of the upper lids and just below the lashes in the lower lids. Through these incisions, he removes excess fat and trims any sagging skin and muscle. The incisions are closed with very fine sutures.

Thats the value of operating as a niche marketer, Donnenfeld said, identifying and developing products for conditions that may not have a satisfactory solution. It doesnt do the retailer any good if we just switch [the consumer] from one product to another, he said. The phrase “home theater” used to be only a dream for most people, but the number of home theaters is growing. A theater-style setting would include speakers behind the viewers as well as in front, and a sound system sophisticated enough to provide separation from side to side and from front to rear. ONeil cites statistics showing that only about 7 percent of homes currently have home theaters, but that figure is expected to skyrocket to around 60 percent in the next few years. The average rate on a 30-year fixed mortgage decreased to 7.53 percent in the week ending Sept. 5, from 7.58 percent the previous week, Freddie Mac said Thursday. “Mortgage rates were down slightly with no compelling economic news to move the bond market,” said Robert Van Order, chief economist at Freddie Mac.
